Terms of Service

These Terms of Service (the "Terms") are an agreement between you and CutoutBG AI ("CutoutBG AI", "we", "us" or "our") and govern your use of the website at cutoutbg.ai and everything offered on it (the "Service"). Please read them together with our Privacy Policy and Refund Policy, which form part of these Terms.

Acceptance of these Terms

By accessing or using the Service, with or without an account, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms for it, and "you" includes that organisation.

Definitions

• Account means the account you use the Service with: a guest account created for your browser, or an account you sign in to with Google.
• Your Content means the images you upload and the processed images the Service produces from them (the Output).
• Tokens are units that meter use of the Service. One token covers one image, whichever background option you choose, as shown on the Pricing page.
• Plan means a monthly or annual subscription, and Token Pack means a one-time purchase of tokens.

Eligibility (18+)

You must be at least 18 years old to use the Service. By using it you confirm that you are. We may close any account we reasonably believe belongs to someone under 18.

The Service

CutoutBG AI removes the background from an image with AI. You upload a JPG, PNG or WebP file and choose what goes behind the subject: nothing (a transparent PNG), a solid colour, the original background blurred, or a second image you upload. Results download as PNG, or as JPG when the background is blurred or replaced.

• Free use: every visitor receives free daily tokens, with or without an account. Free results are full size and carry no watermark.
• Paid use: a Plan or a Token Pack adds monthly or one-off tokens, larger uploads, more jobs running at the same time and a longer history.

The current limits, including file size, image dimensions, supported formats and daily allowances, are shown on the Pricing page and in the upload tool. We may change features and limits to keep the Service working well. If a change takes away something you have already paid for, it will not apply to you until your current billing period ends, or we will offer you a pro-rata refund.

Accounts

When you first pick a file, we create a guest account for your browser. You can sign in with Google at any time, and an account is required to buy a Plan or Token Pack. You are responsible for activity on your account and for keeping access to your Google account secure. Tell us at [email protected] if you think someone has used your account without permission.

Free tokens are meant for one person. Do not create multiple accounts, clear your browser or use scripts, proxies or other tricks to collect extra free tokens. We use automated checks to enforce this, and we may limit or close accounts that break this rule.

Tokens, plans and payments

Tokens

• The tokens a job will cost are shown before you start it, and they are deducted when the job is submitted.
• If a job fails, its tokens are returned to your account automatically.
• Free daily tokens expire 24 hours after they are issued, and unused ones do not carry over.
• Plan tokens are issued each billing month, including on annual billing, and expire at the end of that month.
• Token Pack tokens stay valid for 12 months from the date of purchase.
• Tokens have no cash value, cannot be exchanged for money except as described in our Refund Policy, and cannot be sold, transferred or moved to another account.

Plans

Plans are billed in advance, monthly or yearly, and renew automatically at the then-current price until you cancel. You can cancel at any time from your account page. Your Plan stays active until the end of the period you have paid for and does not renew after that.

Token Packs

Token Packs are one-time purchases. They do not renew and there is nothing to cancel.

Payments and prices

Payments are processed by Stripe, and by buying you also agree to Stripe's terms for the payment. Prices are shown in US dollars on the Pricing page and may include or be subject to taxes depending on where you live. We may change prices; a new price applies to a Plan from its next renewal after we have told you about it, and never to a period you have already paid for. If a payment fails or is reversed, we may pause paid features until it is settled. Please contact us before opening a chargeback so we can try to resolve the problem.

Refunds

Tokens from a failed job are returned automatically. A Token Pack or a Plan payment, including a renewal, can be refunded within 7 days of the charge if none of the tokens it added have been used. The full rules and how to ask for a refund are in our Refund Policy. Nothing in these Terms limits refund rights you have under consumer law.

Your content

You keep all rights to Your Content. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transcode and display Your Content only as needed to run the Service for you, for example to create the Output and show you previews, which includes sending the image to the AI provider that runs the background-removal model. This licence ends when Your Content is deleted, except for copies we must keep by law.

We never use Your Content to train a model. We do not claim ownership of your Output; as far as we have any rights in it, we assign them to you.

By uploading an image, you confirm that:

• you own it or have all the permissions needed to upload and modify it;
• anyone who can be identified in it has agreed to it being processed where the law requires that; and
• processing and using it does not break any law or anyone else's rights.

Acceptable use and prohibited content

Use the Service only for lawful purposes and in line with these Terms. You must not upload, process or share through the Service:

• Content involving minors: any material that sexualises, exploits or endangers minors. This is absolutely forbidden and will be reported to the National Center for Missing & Exploited Children (NCMEC) and other authorities.
• Sexual content: pornographic or sexually explicit material, and any intimate image or video shared without the consent of the people in it.
• Violent or harmful content: graphic violence or gore, or material that promotes terrorism, self-harm or suicide.
• Hate and harassment: material that promotes hatred of, harasses or threatens people or groups.
• Infringing content: videos you do not have the right to use, including copies of films, TV shows or other works made to get around copyright protection.
• Deception: Output used to impersonate someone, to mislead people about real events, or to commit fraud.
• Illegal content: anything else that breaks the law where you live or where the Service operates.

You also must not:

• access the Service through bots, scrapers or unofficial clients, or overload its infrastructure;
• bypass usage limits, security checks or payment;
• probe, attack or reverse engineer the Service or the models behind it;
• resell or provide the Service to others as your own product without our written permission.

We do not review every upload, but we may inspect, block or remove content and suspend or close accounts that we reasonably believe break these rules, without refunding tokens used in the violation. We may report illegal content and share related account information with law enforcement where the law requires it.

About AI cutouts

The model decides what the subject is. Results depend on the image, can differ between runs, and may cut away part of a subject or keep part of a background, particularly around hair, fur, glass, smoke and other soft or transparent edges. Blurring a background hides detail but does not reliably remove information: text, faces and number plates in a blurred area may still be partly readable.

Output is an edited image and must not be used where an unedited photograph is required, such as passport, visa or other official identity documents; several authorities reject photographs altered with software. You are responsible for checking Output before you use or publish it.

File storage

Images from guests and free accounts are deleted 7 days after the job, and images from accounts with a Plan or Token Pack are deleted 180 days after the job. You can delete a result earlier from your history. The Service is not a backup or storage service: download anything you want to keep, because deleted files cannot be recovered.

Our intellectual property

The Service, including its software, models, design, text, graphics, logo and the CutoutBG AI name, belongs to us or our licensors and is protected by intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service as intended. They do not transfer any of our rights to you. If you send us feedback or suggestions, we may use them freely without paying you.

Copyright complaints

If you believe content processed through the Service infringes your copyright, email [email protected] with: your contact details; a description of the work; information that lets us locate the content, such as a download link or job details; a statement that you believe in good faith the use is not authorised; and a statement, under penalty of perjury, that your notice is accurate and that you own or are authorised to act for the owner of the right. We will remove infringing content and close the accounts of repeat infringers where appropriate.

Third-party services and links

The Service relies on third parties such as Google for sign-in and Stripe for payments, and it may link to other websites. We do not control those services and are not responsible for their content, policies or practices. Your use of them is governed by their own terms.

Suspension and termination

You can stop using the Service at any time, and you can ask us to delete your account at [email protected]. We may suspend or close your account, with or without notice, if you break these Terms, if we are required to by law, or if your use puts the Service or other users at risk. If we close an account in good standing for another reason, we will refund the unused part of any Plan or Token Pack.

When your account is closed, your right to use the Service ends and your files and unused tokens are deleted. Sections that by their nature should survive, including those on your content, intellectual property, disclaimers, limitation of liability, indemnity and governing law, continue to apply.

"As is" and "as available" disclaimer

To the maximum extent permitted by law, the Service and all Output are provided "AS IS" and "AS AVAILABLE", with all faults and without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will meet your requirements, produce any particular result or quality, be available without interruption, be free of errors, viruses or other harmful components, or that errors will be corrected.

Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. In that case they apply to the greatest extent the law allows.

Limitation of liability

To the maximum extent permitted by law, CutoutBG AI, its affiliates, suppliers and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities, arising out of or related to your use of or inability to use the Service or any Output, even if we have been told such damages are possible.

Our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence.

Indemnification

You agree to defend and indemnify CutoutBG AI and its affiliates against claims, damages, losses and expenses, including reasonable legal fees, arising from Your Content, your use of the Service or your breach of these Terms, to the extent permitted by law.

Governing law and disputes

If you have a concern about the Service, please contact us at [email protected] first. Most problems can be solved quickly this way, and you agree to try in good faith to resolve a dispute informally for at least 30 days before starting formal proceedings.

These Terms are governed by the laws of the place where the operator of CutoutBG AI is established, without regard to its conflict-of-law rules.

For consumers in the European Union and United Kingdom

If you are a consumer living in the EU or the UK, you also benefit from the mandatory consumer protection laws of your country, and you may bring proceedings in the courts where you live. Because the Service is a digital service that starts as soon as you use it, you agree when you buy that performance begins immediately; if you use tokens from a purchase, you lose the statutory right of withdrawal for what you have used. Our Refund Policy still applies.

United States legal compliance

You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

General

• Entire agreement: these Terms, the Privacy Policy and the Refund Policy are the whole agreement between you and us about the Service.
• Severability: if any provision is found unenforceable, it will be changed only as far as needed to make it enforceable, and the rest of the Terms stay in effect.
• No waiver: not enforcing a right does not mean we give it up.
• Assignment: you may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
• Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our hosting, processing or payment providers.
• Translations: if these Terms are translated, the English version prevails in case of any conflict.

Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date. For material changes, we will give account holders at least 30 days' notice by email or on the Service before they take effect. If you keep using the Service after that, you accept the new Terms; if you do not agree, stop using the Service and cancel any Plan before the changes take effect.
